These Terms of Service ("Terms") govern your access to and use of Fettle ("the Service"), a compliance and certification tracking application. By creating an account or using the Service you agree to these Terms on behalf of your organization.
Fettle provides tools to track certifications and training, store evidence documents, generate compliance reports, and send expiration notifications. Fettle is a record-keeping aid; you remain responsible for your organization's actual compliance obligations and for the accuracy of the data you enter.
You are responsible for safeguarding account credentials and for all activity under your organization's accounts. Administrators control who may access their organization's data through Fettle's roles and permissions.
You retain ownership of the data your organization submits. We process it to provide the Service as described in our Privacy Policy and Data Processing terms. On termination or non-renewal, you may export your records; we are not liable for data lost after you delete it or after account closure beyond any retention window described in those documents.
You agree not to misuse the Service, attempt to access other organizations' data, or use Fettle to store unlawful content.
Fettle has not undergone, and does not claim, FedRAMP authorization, and is not accredited for the handling of Controlled Unclassified Information ("CUI"). The Service, as presently offered, is not designed for and is not suitable for the receipt, processing, storage, transmission, or dissemination of CUI or any data subject to equivalent federal safeguarding requirements, including without limitation the controls set out in NIST SP 800-171.
You are solely responsible for ensuring that data you submit to the Service does not constitute CUI, and you agree not to upload, store, or transmit CUI through the Service. To the maximum extent permitted by law, Fettle expressly disclaims any and all liability for the unauthorized disclosure, loss, or spillage of CUI arising from or related to your submission of such data in contravention of these Terms.
Notwithstanding the foregoing, should a suspected exposure or spillage of CUI be brought to Fettle's attention, Fettle will treat the matter with the utmost care and seriousness and will cooperate reasonably and promptly to contain, investigate, and remediate the incident in coordination with the affected organization.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Fettle's aggregate liability is limited to the amounts you paid for the Service in the twelve months preceding the claim. Fettle is not a substitute for legal or regulatory advice.
We may update these Terms; material changes will be communicated through the Service. Continued use after changes constitutes acceptance.
